This agreement of Terms and Conditions of the applications and the licensing of the same ("Terms") constitutes a binding legal agreement that governs the use of the license of the gaming sites and applications offered by Web2mil S.A.
By accessing these sites or applications directly; or through third-party websites, you agree to be bound by these Terms.
In this document, we refer to Web2mil S.A. as: (“Web2mil S.A.” or “Web2mil”). When we mention the applications of Web2mil S.A. we also refer to the websites, whether they are from Web2mil S.A. or third parties, through which users access the games of Web2mil S.A.
a1) Subject to the acceptance of this agreement, Web2mil S.A. grants you a non-exclusive, non-transferable, and revocable right to use the game and application of Web2mil S.A., exclusively for your personal and non-commercial use. You agree with this agreement to use the applications exclusively for the purposes for which they were designed, with the purpose for which they were conceived, and under the terms and conditions of this agreement.
a2) The licensing of the applications implies the acceptance of these terms and conditions. Furthermore, the use thereof, contrary to the conditions and provisions of this agreement, authorizes Web2mil S.A. to deny you access to them and to revoke your license.
a3) Web2mil reserves the right to modify the Terms in any way and at any time; and will provide notice of any changes to these Terms by one or both of the following methods: Posting on the Website or App. You agree to periodically check the Terms, and agree that the use of the Applications implies acceptance of the Terms. If you do not agree to these Terms, then you must stop using our applications immediately. You ensure that you are over 13 years of age, and also ensure that, if you are under 18, your father, mother, or legal guardian have read this agreement and agree to its terms.
a4) Web2mil reserves the right to interrupt the operation of the applications or change the content of the same at any time and without prior notification or notice of any kind, without any liability.
b1) Users of Web2mil S.A. application licenses ensure that the information in your registration is accurate, complete, and up-to-date. The licenses of Web2mil S.A. are offered on various social networks and sites. Notwithstanding this, the access and use of the licenses or applications of Web2mil S.A. are subject to the Terms set forth herein.
b2) You are solely responsible for all activity on your account or registration, as well as the security of your password and access to your account. You agree to indemnify or hold Web2mil S.A. harmless from any misuse that has been given to the license by you or any third party that has accessed your account. If your account is terminated by Web2mil S.A., the use of Web2mil S.A. applications will only be possible with the express authorization of Web2mil S.A.
b3) The same user cannot access the applications of Web2mil S.A. from more than one account. You ensure that the data provided in your account is true, current, and, verifiable and that if Web2mil has reason to suspect that the information in your account is false, inaccurate, incomplete, or out of date, Web2mil has the right to suspend or terminate your account without the right to any claim on your part. Web2mil S.A. further reserves the right to terminate any account or user registry that is inactive for more than 180 consecutive days.
b4) The applications of Web2mil S.A. have been developed with the exclusive purpose of providing entertainment for the people who use them, any use of them for purposes other than this is a violation of these Terms, and authorizes, but does not limit Web2mil S.A., to the suspension or immediate termination of the account or registration.
c1) Unless otherwise specified, the features offered by the applications are software property of Web2mil S.A. (with license), and are therefore protected by copyright; its unauthorized copying or use is prohibited. The contents of the site, applications, logos, and trademarks are the property of Web2mil S.A. and may not be used without the express consent of Web2mil S.A. You agree not to copy, further develop, modify, alter, download, transmit, publish, distribute or exploit material from this site or application, without the prior consent of Web2mil S.A. you further agree that any idea suggested, offered, or proposed to Web2mil S.A. for the improvement or change in the application, will be the exclusive property of Web2mil S.A., and Web2mil S.A. can then use it, sell it or exploit it, without restrictions or compensation for you or third parties.
c2) Neither the use of the license, nor the extension of it by the purchase of virtual goods, credits, beans, tokens, stones, nor the download of any material, etc. grants you any property rights, not even for the purchased goods, which you agree are of no material value.
d1) The applications may include the aforementioned items (virtual currency) that can be purchased with real money by users of legal age in their country of residence. The applications can also include virtual goods and subscriptions, which can also be purchased for real money. Neither the virtual currency, the virtual goods, nor the subscriptions, can never be transformed into money, goods, or any other object that has real monetary value, neither by Web2mil S.A. nor by third parties.
d2) When you buy virtual currency, virtual goods or subscriptions in the Web2mil application, you acquire a limited license, revocable, non-transferable, or sublicensable to use them in the Web2mil S.A. application.
You agree not to have any right or title over the goods acquired, or over any attribute originated or generated with the use of the application or the acquired goods.
d3) The transfer of virtual currency or virtual goods is expressly prohibited, except when expressly stated. You may not sell or trade these assets for real money or any material goods. Doing so may result in the definitive suspension of the use of the application by Web2mil S.A. to the user who performs it, and at the same time, be subject to legal action.
d4) You agree that purchases of virtual goods, or currencies are final and that there will be no refund of any kind, except that Web2mil decides to do so at its sole discretion.
Any possession of currency or virtual goods will be terminated without the right to any claim if Web2mil S.A. or one of the application stores decides to suspend or discontinue the application. The same applies to the suspension or definitive removal of a user by, and at the sole discretion of, Web2mil S.A.
d5) Web2mil has the absolute right to regulate, manage, change prices, control, modify or eliminate virtual currency or virtual goods at its sole discretion and at any time. Exercising this right will not generate any liability.
e1) Some games developed by Web2mil S.A. may offer subscription services. By purchasing a subscription, you are entering into a periodic subscription contract with us and requesting immediate access to the subscription services.
e2) When purchasing a subscription through a platform such as Apple, Google, or Amazon (or any store through which our applications and subsequent subscriptions may be available, from now on the "platform"), the platform's payment terms will apply, and you should refer to their payment terms for more information.
e3) Subscription charges will be applied to the payment instrument you provide at the start of your subscription, or to a different payment instrument if you update your account information. Please note that prices and charges are subject to change, and we will notify you in advance of any changes to the subscription rate.
e4) Your subscription will automatically renew at the beginning of each billing period unless you cancel it or we terminate it. To avoid automatic renewal, you must cancel your subscription before the next billing period begins.
e5) If you purchased a subscription through a platform such as Apple, Google, or Amazon, you can cancel directly through the platform by following their instructions provided on their customer support websites or contacting their customer support.
e6) Please note that subscription payments are nonrefundable, and we do not provide refunds or credits for partially used subscription periods, except possibly for customers who reside in certain regions, refer to the platform's payment terms for more information on exercising this refund right.
e7) Occasionally, Web2mil S.A. games may offer one-time or limited-time offers to players with active subscriptions or those who start a subscription. Please note that these offers are not included as part of your ongoing subscription.
f1) The application may allow or invite you to participate in chats, forums, blogs, etc., and offer you the possibility of creating and/or sending content.
You agree to be the owner and have the distribution rights of this content, you agree to keep Web2mil S.A. harmless from the damages that the dissemination of this content may cause to you or third parties. Whatever this content, it will be processed by Web2mil S.A. as non-confidential nor will it be considered the property of Web2mil S.A.
f2) Web2mil is not obliged to monitor or enforce intellectual property rights that its content may infringe, but you authorize Web2mil S.A. to take any steps necessary to protect these rights, including, but not limited to, suspending your account.
Web2mil S.A. is not obligated to monitor or review the content but maintains the right to delete or modify it at any time and without explanation. You agree that Web2mil S.A. is not responsible for the content or its monitoring, nor for the offensive nature that it may have for you or third parties.
f3) Under the terms of this agreement you grant Web2mil S.A. an unrestricted, unconditional, irrevocable, royalty-free license to use, distribute, reproduce, sell, license, publish, transmit, modify, create derivative works from, translate, archive, and copy such content. As well as the commercial exploitation of the same, totally or partially, in any possible way, in addition to its promotion and dissemination.
You agree that the use of the application will be carried out under the following general conditions and particular rules of each application. You agree that all your conduct will be in accordance with the law and with the following principles:
g1) You may not make or disseminate offensive or discriminatory comments of any kind, whether based on sexual orientation, nationality, race, or any other distinction or preference.
g2) You will not use obscene, indecent, pornographic, sexual, offensive, or objectionable language.
g3) You will not use the application to defame, ridicule, threaten, intimidate, or abuse any user or third party.
g4) You will not use the application to violate contractual, intellectual property, or any type of rights of any person, or promote illegal activities.
g5) You will not use the application to divulge information about any other person, which can be used to individualize, contact, or falsify the identity of the same.
g6) You will not use the application to falsify your identity or use someone else's identity.
g7) You will not use the application to create accounts by automatic means, and/or mislead others.
g8) You will not use the application to carry out commercial activities, nor will you promote the use of services or products.
g9) You will not use the application to disseminate software of any kind, in particular viruses, trojans, etc., or any other software that may harm a third party.
g10) You will not use the application to spam.
g11) You will not copy or attempt to decompile any part of the application.
g12) You will not use any type of software that does not allow the identification of the user or the content provided by you, such as an anonymous proxy or similar.
g13) You will not use the application to sell or transfer goods or virtual money to third parties, accounts, or any type of content or product.
g14) You will not engage in cheating or any other attitude that is considered contrary to the spirit of the application.
g15) Web2mil S.A. does not support or control any message, post, or information that is disseminated by the users of the applications on the site or other sites, and specifically, disclaims any responsibility for them.
g16) Privacy Policy: Web2mil S.A. respects the privacy of the users of its applications. When you use our applications, you expressly authorize the use of the information that you share with the application, and/or the use of the information that it needs for its operation.
If you do not agree with our privacy policy and terms of use, do not use our applications. For more information, you can contact soporte@web2mil.com.uy.
You agree that in case of non-compliance with the rules and conditions of use of the license of applications of Web2mil S.A. mentioned previously, Web2mil S.A. reserves the right to temporarily or permanently suspend your use of the chat and/or user account that you have in the applications of Web2mil S.A.
We reserve the right, but not the obligation, to monitor or attempt to resolve disputes between you and other users. You agree to indemnify Web2mil S.A. of demands and damages of any nature originated by a dispute between users.
i1) You agree that the use of these applications is at your own risk and that the same does not provide any guarantee. Web2mil does not guarantee the uninterrupted operation of the application, nor that it is free of operating errors; including errors of any kind, loss of property or virtual currency, hardware, software, or communications. Web2mil S.A. is not responsible for the goods or services offered by advertisers on the site. Nor does Web2mil S.A. ensure that the ranking, graphics, levels, movements, or data provided by the application are free of errors and that these are used properly by the application.
i2) You agree that in any circumstances and for any concept, you can only claim from Web2mil S.A. the sum that you have paid to Web2mil in virtual goods or money in the 60 days prior to the claim that you have presented to the company.
i3) This limitation of responsibilities is the maximum allowed by the Law and will apply to all damages or losses caused or related to the use, or the impossibility of using the applications developed by Web2mil S.A., as well as for the use or impossibility of use, that third parties make of the applications.
j1) You agree to defend and hold harmless Web2mil S.A. for all costs and disputes, including attorneys' fees, arising out of the use of the application; and that this clause will survive the termination of your account or use of the application.
You also agree that any claim or dispute related to the licensing of the applications must be resolved within one year from its presentation or it will be declared null and void forever.
If you believe that any material contained in the Web2mil S.A. applications violates the Copyright Law, you can send us an email requesting the removal of the material, or the blocking of access to it to soporte@web2mil.com.uy.
